General Conditions of Use
www.utsit.fr (the “Site”) is published by Utsit (hereinafter referred to as Utsit). The legal notice of the Site can be accessed via this link. The current version of these terms and conditions (the “Terms and Conditions” or “T&Cs”) is the only version enforceable during the entire duration of the Site’s use, until a new version replaces it.
PREAMBLE: Definitions
User: refers to any natural or legal person, client or visitor, connecting to the Site, for any reason whatsoever.
Client: refers to any natural or legal person who has entered into a service or training agreement with Utsit.
Offer: refers to all Services marketed by Utsit on the Site.
Services: refers to all services related to consulting in the field of payment systems and electronic transactions, including training offered by Utsit, as well as access to the Site and navigation within the Site.
Access to the site:
The T&Cs are enforceable against the User of the Site who acknowledges having read them, accepts them expressly without reservation, and agrees to comply with them during the entire duration of the Site’s use, as well as all applicable laws.
Rule No. 1: Respect for the rights of third parties
It is specifically prohibited, but not limited to:
- Defaming, insulting, harassing, or stalking other Users or representatives of Utsit.
- Impersonating other Users or third parties.
- Posting false information, including the creation of fake accounts.
- Preventing other Users from accessing or using the Site.
- Promoting any religion or religious activity.
- Offering any commercial promotion or preferential pricing for another company or service.
Rule No. 2
It is specifically prohibited, but not limited to:
- Transmitting viruses, worms, defects, Trojans, or any other destructive element that could steal or reveal another User’s data.
- Promoting or providing instructions on illegal activities.
- Promoting physical or moral violence against a group or individual.
- Using a robot or any other device to retrieve or index part or all of the Site or to collect information on Users for unauthorized purposes.
In the event of non-compliance with these rules by a User, Utsit reserves the right to apply sanctions. These sanctions will be decided on a case-by-case basis, depending on the situation and the severity of the facts attributed to the User.
Utsit may, in particular:
- Restrict or suspend the User’s access to the Site.
- Temporarily or permanently ban the User from accessing the Site.
Utsit may also take legal action to hold the User civilly or criminally liable if their actions harm the Site, in order to seek compensation.
Intellectual Property:
All intellectual property rights related to the structure and content of the Site (including images, sounds, videos, photographs, texts, animated images, logos, and data) are the exclusive property of Utsit. These intellectual property elements are made available to Users solely for the purpose of using the Site in accordance with these T&Cs.
Any reproduction, representation, use, or adaptation in any form of all or part of the elements of the Site is prohibited and constitutes an infringement of copyright.
Each User undertakes not to extract or reproduce, publish, transmit, use, or modify, for commercial or non-commercial purposes, all or part of the offers and commercial presentations published on the Site or present on any other media. Such illegal acts engage the responsibility of their authors and may result in legal action.
Personal Data:
Utsit is the data controller for personal data collected on the Site. These data are provided by their owners and processed in Utsit’s legitimate interest, including for commercial and marketing purposes. To learn more about the management of personal data, please refer to our Privacy Policy.
The personal data collected on the Site includes the following: identity data (gender, first name, last name), contact data (email, home address, phone number), navigation data (IP address, cookies, log files, location logs).

Utsit’s Responsibility:
The statements made and the description of Services offered on Utsit’s Site are non-contractual.
Utsit’s liability cannot be engaged in the following circumstances:
- Failure, breakdown, difficulty, or interruption of operation preventing access to the Site or any of its features.
- Loss of data or information stored by Users on the Site. It is the Users' responsibility to take all necessary precautions to store the data and information they upload to the Site.
- In case of direct or indirect damage caused to the User, regardless of the nature, resulting from access, management, or use of the Site.
- The abnormal or illegal use of the Site by any of its Users.
For content published in comment sections, the User assumes full editorial responsibility for the content they publish on the Site. Utsit will make every effort to promptly remove any content deemed manifestly unlawful upon notification.
The User’s equipment used to connect to the Site remains under their full responsibility. They undertake to take appropriate measures to protect their equipment and data, especially against viral attacks over the internet.
Utsit is not responsible for any damage caused by Users to themselves, third parties, and/or their equipment due to their connection or use of the Site.
Links to Other Websites:
The Site may contain hyperlinks redirecting the User to third-party websites operated by others. Utsit does not exercise any control over the destination of these hyperlinks. These sites are not edited by Utsit, and Utsit cannot be held responsible for access to, content, or use of these sites by the Users of the Site. The posting of hyperlinks by Users is their sole responsibility.
General Provisions:
The invalidity of one or more clauses of these Terms and Conditions will not affect the validity of the entire Terms and Conditions.
Governing Law:
These Terms and Conditions are governed by French law and are subject to the jurisdiction of the Commercial Court of Paris, unless a specific allocation of jurisdiction arises from a law or regulation.
